VIDEO: Legislator Has Insane Meltdown On Camera Over Speeding Ticket - Video Vindicates Officer

Ulster Police Officer Gary Short stopped Berky for speeding in May, and the town of Ulster released the video earlier this week.

Ulster County, NY - The long-awaited dash-cam video of a traffic stop meltdown involving Ulster County Legislator Jennifer Schwartz Berky has been released.

The video was released Tuesday, October 24, by the Town of Ulster Town Board after several FOI requests, according to HudsonValleyOne.

Ulster Police Officer Gary Short initiated a traffic stop of Berky for speeding 43 mph in a 30 mph zone in May.

He appears courteous and professional throughout the traffic stop, as shown in the video.

In the video, Officer Short can be seen approaching Berky's Prius in an Aldi's parking lot after following her for about a quarter of a mile from the intersection of Ulster Avenue and Morton Boulevard onto Route 9W.

Berky asked Officer Short why she was stopped, and he told her it was for speeding 43 in a 30 mph zone.

In the video, Berky almost immediately brings up the fact that she works for the county and is a county legislator. She told Officer Short that she was doing the same speed as everyone else.

Berky can also be seen having what looks to be some type of panic attack, although she does calm down afterward. Officer Short offered to get her medical assistance but she refused.

She continued to argue and question Officer Short through the video, and told him once that she didn't trust him and didn't feel safe with him. Another officer had arrived to assist by then.

Officer Short initially wrote Berky a ticket for failure to wear seat belt, but she told him to write him for what he stopped her for. He then wrote her for speeding and she said she wanted the initial ticket back.

Officers have discretion when issuing tickets and will often write the ticket for a lesser offense to help a defendant.

Berky also told Officer Short that she was recording him, and he advised her that the stop was being recorded both on dash-cam and body-cam video.

On Friday, October 27, Berky publicly apologized. In her apology, she said:

"The video released earlier this week of my Town of Ulster traffic stop captured a tough moment for me. Like so many working families, I too face tough times and stressful situations. As a professional, a public servant and a mother, I know my interaction with Police Officer Gary Short was unacceptable. I want to apologize to Officer Short and thank him for his patience and professionalism with me during a very difficult time.

This has been a humbling experience for me. I hope to use it to grow and learn how to better represent the diverse working families who reside in the great the city of Kingston.”

Berky's attorneys objected to the release of the video and argued that release of the video would affect her ability to receive a "fair trial" for the speeding ticket.

Berky represents the city of Kingston in the county legislature, and is up for re-election on November 7.

We all get to talk our way out of a ticket. The woman was under stress from finances. She had a MAJOR panic attack!! She was still in that mode when the officer tried to give her a reduced ticket and she didn't understand. A person does not think clearly when having an attack. When she started to calm down she asked about the prior ticket. It was up to the officer which ticket to give her. I think he could have shown more empathy to her and given her the first ticket!! It was up to him. She miss a job interview and she was worried. I back law enforcement but I disagree with how he proceeded. At that point he was upset it took so long, so he gave her the larger ticket. He should have waited for he to calm down. He saw her hyper-ventilating and didn't have the courteous matters to allow her to calm down. I understand what she was going thru. He saw it and ignored it!! Again show some empathy!! This is why people get upset with the police.

Ava, we "all" don't get to talk our way out of a ticket. I have had tickets for speeding and never once tried to talk my way out of it. I was speeding (so was she) and I just apologized and accepted my ticket like an adult! Maybe you have acted like her and that is why you empathize with her outburst. She tried to use her position to get out of that ticket and when it didn't work she worked herself into a frenzy. The officer was more than patient with her and offered her a lesser penalty but she wouldn't shut up long enough to listen. Then she wanted it back to use against him in court. She obviously has some mental issues and I feel sorry for the district she represents. I would not have the patience this officer did and I am sure she gave him a bunch of crap in court as well. God bless our police and all first responders!

Once she found out there was a video of the stop and interaction during the stop, she knew she was caught. Interesting to note that she tried, basically, to intimidate the officer by saying she was a county legislator. So what. Pay the violations!

So he DID show empathy by offering her the seat belt ticket until she started acting like a two year old. What would you expect him to do? Give her a big bear hug, massage her shoulders and kiss her ass until she's satisfied - so she can turn around later and say he groped her and tried to rape her? He offered medics. He's not obligated to calm her down by touching her - that would be stupid. He already took too long with her hissy fit. I saw an extremely professional and patient officer who did everything right. Do you realize how many times he has to listen to BS excuses and hissy fits when he pulls someone over? He didn't make the laws. He's only enforcing them.

Thank you MadMaxx for summing it up for me, so I don't have to quote Saturday Night Live's "Jane you're an ignorant slut!" to her. I would have sworn I heard that old bat yelling "PTSD!" Aside from her acting like a five year old, this is the one thing that really irritated me. Her claim of a panic attack and PTSD. I have had PTSD for years and one of my worst panic attacks lasted for five days straight. They don't just come and go at will when you want to get out of a ticket.

The only reason she apologized was because she was caught on camera and realized how stupid she looks. If you look up her background, she's been in different countries and has an extensive education among other things. She's got a pretty nice car, and with her education, I can't see how she planned so poorly that she can't afford insurance when she decides to speed. Her first words about being a legislator tells me she thought she was above the law, and when she found out she couldn't use that, she got pissed. Don't speed and you wont get that ticket. Just because all of the other lemmings are jumping off a cliff, doesn't mean you should too. The police can't pull them all over.
