VIDEO: Handcuffed Suspect Spits In Cop's Face, Then Cop Knocks Him Out

Denver Police Cpl. Michael Oestmann is still facing an internal affairs investigation into the incident.

Denver, CO – A Denver cop was charged with third-degree assault after he knocked a handcuffed man unconscious for spitting in his face (video below).

Denver Police Corporal Michael Oestmann was working off-duty at Jackson’s Hole Bar on 20th Street in downtown Denver on April 14 when the incident occurred, according to KCNC.

Cpl. Oestmann had detained Kevin Watson for his involvement in a bar fight.

The officer put Watson in handcuffs and sat him down in a chair in the back room at the bar, KCNC reported.

Bodycam video showed that the man sat and spewed insults and obscenities at Cpl. Oestmann for at least five minutes before the altercation happened.

The video began with Watson spitting on the floor.

“I don’t care if you spit on that floor,” the corporal told him in the video.

Watson began insulting Cpl. Oestmann, repeatedly calling him a b---h who didn’t make any money, and making remarks about the officer’s girlfriend.

“You can’t afford s--t. You’ll never make s--t, forever!” Watson sneered at the officer.

Cpl. Oestmann refrained from responding to the man for several minutes as Watson alternately spit on the floor and muttered insults at him.

Watson challenged the officer to remove his handcuffs for a fight, but the Cpl. Oestmann did not allow himself to be goaded.

“Are you scared? Are you scared?” Watson asked in the video.

“Do I look scared?” Cpl. Oestmann replied.

The video showed Watson continued picking at the officer, trying to get a reaction.

“You’re not worth my time,” Cpl. Oestmann told him.

The corporal maintained his cool for almost five minutes, until Watson leaned back and spit a wad of saliva that hit Cpl. Oestmann in the face.

Cpt. Oestmann closed the space between himself and the suspect in a split second.

He kneed Watson in the chest and punched him in the face, according to KCNC.

The exchange left Watson unconscious.

“You will not spit on me again!” the furious officer yelled. “Do you understand me?”

“We need a use-of force and a supervisor here,” Cpl. Oestmann radioed the dispatcher in the video.

"What was that about being a bitch? Who's unconscious now?" the corporal asked the limp man.

Then he told other officers nearby that the suspect had spit in his face.

Watson nodded in and out of consciousness after the assault, according to the Denver Post.

“I may have gotten a little violent there,” Cpl. Oestmann told Watson after the attack.

The Denver Post reported that other footage from the corporal’s bodycam showed him telling somebody else at the scene that he had “just kind of lost it” when Watson spit in his face.

Cpt. Oestmann was charged with third-degree assault in the incident, KCNC reported.

He reached a plea deal with the Denver District Attorney’s Office for deferred judgement that will result in no jail time.

According to KDVR, the corporal must complete a year of probation and anger management classes, and then his record will be cleared.

But the resolution of the criminal case doesn’t mean that Cpl. Oestmann is out of the woods yet professionally. He still has to face discipline for whatever department policies he may have violated.

“The Denver Police Department takes use-of-force incidents seriously and has a robust internal investigation process, which includes oversight by the Denver Office of the Independent Monitor, and an established disciplinary process when issues rise to that level,” the Denver PD said in a statement. “With the judicial proceedings concluded in Corporal Oestmann’s case, we will work to complete our internal investigation into the incident. It would be inappropriate for us to comment further at this time, as the investigation is still ongoing.

KDVR reported that the corporal had been assigned to desk duty pending the outcome of an internal affairs investigation.

Police officer did what his father should have done many years ago. The possible this would have never happened. Probably not, he’s just a straight up a—hole who disrespects everything and everybody. I am surprised the officer took to long but kudos to him.

If there’s one thing I learned taking crisis management instructor training, it’s that a large portion of the population will absolutely snap when you spit in their face. That POS is lucky a short nap is all he got.

The comments on this site are extremely disturbing. They seem to prove what is really wrong with the entire police force in this country. They also reinforced every stereo typical comment I have heard about officers ie they're all criminal cowards, paid Liars, wimps who couldn't fight without their gun and badge, people that were bullied and High School and are getting revenge, etc.
I know some people say that there are good cops, but if there were, they wouldn't stand for the likes of this officer. The same criminal standard should be held for officers that is for civilians. Felonious assault is felonious assault. You could not see any spit going towards the officer on this video but you could see the officer attacking this man, knocking him unconscious, and then twisting his neck which could be construed as attempted murder. yet he gets off with a slap on the wrist. had the roles been reversed, the guy in cuffs would be in prison for a long time, that is if he survived the severe beatings of the rest of the officers present. Perhaps you should all remind each other you are not supposed to be the highest-paid criminal gang members in the country before each shift. You were supposed to be there to help people. to protect and serve.

Wait a second.... this officer punches a HANDCUFFED person. Did he deserve it? probably, but that doesn't justify the officer in knocking him out.

This wasn't self defense, this was "I'm angry that you spit on me so I'm going to take my anger out on you." He deserves to be criminally charged for his actions, just like anyone else who does that to a HANDCUFFED person.

C'mon guys, I back the blue, and give the benefit of the doubt to almost any officer, but there is right and wrong, and this officer was clearly in the wrong here.

If the guy is HIV or Hep-c the Officer will have a year of blood tests, no relations with his wife and will have to act as if he has HIV with his kids and all medical appts. Been there and done that makes for a stressful year for Officer and family. The bad thing is the medical people cannot tell if they have HIV or Hep-c so you have to go thru with a year of blood test that show clean anyways.

Officer showed great restraint. Suspect assaulted the officer with bodily fluids. Officer stopped the attack from continuing. Suspect is alive and fine. This was a justified use of force. No serious injury to the poor suspect. Police are human beings and can only take so much, LEOs take far more harassment than anyone else would ever put up with before acting. This was a criminal attack on the officer, potentially a serious one because you do not know what contagious diseases with which the suspect may have infected the officer.

The real bitch got what he deserved. The Officer actually showed exceptional restraint. How much of that verbal abuse and then get spitting spit in his face should any human put up with? He lasted 5 minutes plus whatever this punk did prior to being cuffed and seated. I wouldn’t have made it that long. After about 2 minutes, I would have gotten in his face and told him, one more word like that comes out of your mouth, I’ll knock you the f*** out. Nice job, Officer.

Go here and file a complaint on the City of Denver for messing with this officer in the first place and then you can file a commendation for the officer for not shooting Watson! LOL! They state they assign a case# to EVERY complaint, put it on 'em! denvergov.org/Police
