VIDEO: Father, Son Arrested After Fatally Shooting Man Threatening To Kill Them

John and Michael Miller shot Aaron Howard on Sept. 1, after he threatened them during a dispute over garbage.

Abilene, TX – A man is dead after trash in an alleyway sparked a dispute between neighbors (video below).

The incident began on the morning of Sept. 1, after 37-year-old Aaron Howard and his common law wife, Kara Box, found a mattress they’d put in a dumpster in their alley deposited back onto their lawn, the Star-Telegram reported.

Howard pick it up and put the mattress back into the dumpster, Box said.

Then 67-year-old John Miller, Howard’s next-door-neighbor, took the mattress back out of the dumpster and dropped it on Howard’s lawn.

Box said Howard told John Miller to put the mattress back in the trash, and Miller refused.

She said she began filming the altercation when John Miller pulled a handgun out of his pocket, and then his son joined him in the alley with a shotgun over his shoulder.

Words were exchanged and tempers flared. Howard’s brother handed him a baseball bat, the Star-Telegram reported.

In the video, John Miller is shirtless and in shorts, and his 31-year-old son Michael Miller is shirtless in jeans.

“Oh yeah, you’re going to jail,” Howard said as the cellphone video began.

“No I’m not,” replied John Miller, who remained calm throughout the entire altercation.

At that point the video showed that Aaron got right up in John Miller’s face pointing.

“Get away from him,” Michael Miller warned Howard.

Howard then turned and told somebody off camera to “go get me my BB gun,” the video showed.

“Back off. Back off,” John Miller warned Howard, never raising his voice at the enraged man. “If you come any closer, I’m going to kill you.”

“Hey, did you hear him say he’s gonna kill me?” Howard asked somebody off camera.

“You pulled a gun in front of my kids,” Howard started screaming, advancing on John Miller.

The children were nieces and nephews that belonged to his visiting brother, Box told the Star-Telegram. No children can be seen or heard on the video.

“Point it at me! Point it at me!” Howard antagonized the Millers.

“I’m standing my ground,” Howard yelled as he continued to get closer and closer to John Miller, the video showed. He sounded as if he were growling.

“So are we,” John Miller responded.

“No you ain’t!” Howard yelled.

The men disagreed about whether they were in the Millers’ driveway or an alleyway, the video showed.

“You’re dead. I promise you, you’re dead,” Howard began threatening John and Michael Miller. “I’m going to kill you.”

“I doubt it,” John Miller replied, deadpan.

Michael Miller told Howard that if he was going to show the video to the police he might want to stop threatening to kill them.

Howard was not amused, and told Michael Miller he was going to kill him too, the video showed.

“Oh no! I don’t give a f--k,” Howard began, and then let loose with a long string of obscenities.

“Point it at me! Point it at me!” Howard dared John Miller over and over again.

“Go ahead, take a swing,” John Miller calmly told the baseball bat-wielding man.

Howard got closer and closer to the Millers, but John Miller never move toward Howard once during the exchange, the video showed.

His son stayed behind him the whole time.

John Miller repeatedly told Howard to “back off” and Howard responded with “you’re a dead man.”

“I doubt it,” John Miller replied yet again, infuriating Howard.

“You better quit threatening,” Michael Miller told the enraged man, as he exhibited the same calm demeanor as his father, the video showed.

“If you come within three foot of me, I’m gonna kill you,” John Miller told Howard very clearly.

Howard stepped closer to him and then Box suddenly stepped into the middle.

“You’re not going to shoot my husband,” Box told John Miller, as she continued to film the exchange.

“Shoot me!” Howard told the Miller men.

“You’re dead,” he threatened them, as the video showed him moving closer to the father and son.

At that point, Michael Miller took the shotgun off of his shoulder and held it in a low-ready position.

“Point it. Point it,” Howard said as he advanced on John Miller.

Two shots were fired and the camera lost focus. It refocused on Michael Miller as he was racking his shotgun, and then the two more shots can be heard as the video lost focus again.

Box told police that after the shooting, John Miller held his gun to her head and Michael Miller ordered Howard’s brother to the ground at gunpoint. They held them there until police arrive, the Star-Telegram reported.

John and Michael Miller were both arrested and charged with first degree murder.

The Star-Telegram reported that both men had been released after posting $25,000 bail each.

The man that was killed was out of control without question and did make threats to kill. Not very smart. The wife did not help matters. She should have had sense enough to call the police. The 2 armed men should have walked away. Charges are warranted.

My guess is by going slide by slide Howard may have raised the bat to strike the Dad, Dad gives Howard a double tap, raises his arm to block the bat strike while firing a delayed third shot. Bat gets thrown at either Dad or Junior & Junior gives Howard a double tap. I say it's a good shoot, depending on "stand your ground" rules. Howard certainly had the intent/ability/means to cause death or serious bodily injury to either of these men. Lesson: Never bring a bat to a gun fight! All over a dumpster. Sad.

Well, first observation - the father and son duo sure are physical specimens. It's no wonder they had guns to defend themselves against a much larger adversary. If they were on their own property they had no reason to back off, although in retrospect that would have been the prudent thing to do. Even if they were justified, the legal expenses and time in jail makes this a head scratching decision on their parts.

Sad video to watch and again we are shown a couple minutes of the whole situation . Who knows what occurred , leading up to the Father and son to arm selves . Who knows of previous confrontations between families leading up to such anger . I will let the Courts decide right or wrong

"You're not going to shoot my husband." Guess who was wrong today? The level of brilliance here is mind boggling. When someone has a firearm out and has said they are going to shoot you if you come close to them...you might want to take their word for it. Because if you don't, it can be a life ENDING decision. Add to this that there was another person with a shotgun backing the person with the pistol up and the stupidity is even greater. Here is a tip for all you wonderful arm chair lawyers.....its better to be tried by 12 than carried by six. Mr. Baseball Bat and Mrs. You're not going to shoot my husband seem to have forgotten that. And based on the video, the guys that shot them will probably walk free after a huge amount of legal grief. This is Texas people. When someone says they will shoot you here, you better believe them. Its not worth betting your life they won't.

this may very well become another legal question as to what stand your ground and being threatened are. the father and son could have retreated, but by the same token the bully (and he was that) was threatening in manner, tone and eventually with weapon. The father/son duet were mostly calm, collected and controlled but "covertly" threatening? maybe. The idiot "wife" saying "our kids", they don't have kids and if so worried, why stay out causing even louder confrontational behavior (drugs and/or alcohol?). I think father/son will be charged with something in varying degrees, but something.

I wonder whether stricter federal gun control laws would have prevented this tragedy. Even if it turns out that the shootings were legally justified, this particular situation clearly would have turned out better for everyone if without firearms had not been brought to bear. I think this is exactly the type of thing that the Founding Fathers were trying to prevent when they said "well-regulated militia only need apply."

I don’t think stand your ground applies. I believe in lawful gun ownership and in the right to protect yourself. In this case if they were law abiding citizens they would have called the law and walked away during this encounter. I think they should go to prison. I feel for the widow, however she should’ve called police instead of filming and encouraging her husband to fan the flames leading to His murder

This was such a unnecessary Death/murder so sad. No one called the police and neither party backed down I’m sure because of their pride. Then it was over a mattress that was in the trash in which the father and son took the time to take it out the trash and put it on the neighbors lawn. It’s Ludacris!!! So senseless was it a public trash for that area? Where they on bad terms already? So many questions? If I was on the jury my decision would be Son and father LIFE W/O PAROLE!! Can’t help but thinking the man that died never knew when he woke up that morning that he would be dead by 5:00pm over something so worthless and meaningless and same race so no one can play the race card. My heart and deepest condolences and prayers to both families. You see this and wonder if any of them had a second chance at this knowing the outcome.....what would they do different

Texas law mentions multiple time in the code that if the actor provokes the subject the defense will not be justified. I believe it will be a stretch if the defense atty can claim these two were not provoking this encounter.
