Albuquerque, NM – Authorities are investigating why a Rio Arriba County sheriff’s deputy deployed his Taser on a detention officer in the parking lot of the county jail (video below).
The incident occurred at about 9:30 a.m. on June 3 after Rio Arriba County Deputy Leon Gallegos arrived at the jail in his marked police vehicle, the Albuquerque Journal reported.
The surveillance video of the fenced parking lot showed that Deputy Gallegos and two other vehicles were sitting on the street waiting for the gate to be opened.
The video showed two detention officers walked outside the jail and opened the gate, and all three vehicles pulled in.
Deputy Gallegos was the first out of his vehicle, and walked around to the truck of his car.
“Deputy Leon opened the trunk of his marked sheriff’s vehicle and stopped behind the car facing as if to place items in the trunk,” Detention Officer Terrance Garcia said in a statement, the Albuquerque Journal reported.
He opened the trunk just as Detention Officer Timothy Gallegos approached him, the video showed.
Larry Deyapp, the jail administrator, told Blue Lives Matter that Deputy Gallegos and Detention Officer Gallegos are not related.
Detention Officer Garcia said he heard the deputy say something to Detention Officer Gallegos and then turn toward his colleague “while brandishing a black object in his hand.”
The video showed that Deputy Gallegos had his left hand on his Taser in its holster as the detention officer approached.
In his statement about the incident, Detention Officer Gallegos said he was joking when he walked up to Deputy Gallegos and told him to stop honking his horn “at my jail.”
He said the deputy told him it wasn’t “his jail” and that they laughed.
But then Deputy Gallegos did something that wasn’t the least bit funny.
“We then both laughed and he pulled his issued Taser and tased me in the groin,” Detention Officer Gallegos told jail officials.
The video showed Deputy Gallegos pulled his Taser out of the holster and shot Detention Officer Gallegos as soon as the man reached his vehicle.
The Taser’s prongs embedded in Detention Officer Gallegos’ genital area, causing him to drop to his knees in the parking lot.
The video showed Detention Officer Gallegos appeared to be in extreme pain as he tried to walk it off in the parking lot of the jail.
He kept stopping to bend over and dropped to his knees a few more times, the video showed.
Afterward, he told the jail administrator what had happened and Deyapp “advised me to do the proper documentation and go get checked out by a physician,” the Albuquerque Journal reported.
Detention Officer Gallegos suffered a serious injury as a result of being tased, according to KOB.
Rio Arriba County Sheriff’s Major Randy Sanches said the use of the Taser was “accidental,” according to the Albuquerque Journal.
But Deputy Gallegos has been placed on paid administrative leave while the sheriff’s department investigates the incident.
Attorney Shannon Kennedy saw the video and is familiar with the case, according to KOB.
"I saw an abuse of authority,” Kennedy said. “This is a deputy who has been armed with a weapon. He takes his hand, points that weapon and he shoots it. That is a civil rights violation of the 4th Amendment of the United States Constitution and the 14th Amendment."
“Now being hit in the groin area is going to be painful, regardless, but 50,000 volts of electricity into the groin area is unimaginably painful,” the attorney added.
