Victim Shoots Armed Robber, Gets Arrested For Not Having Concealed-Carry Permit

Araceli Diaz was arrested because she didn't have a concealed-carry permit for the gun she used to defend herself.

Chicago, IL – A 21-year-old woman who shot an armed 14-year-old girl who tried to rob her on Friday night is facing charges because she didn’t have a concealed weapons permit for her legally-owned handgun.

The incident occurred at about 5:45 p.m. on Nov. 29 when Araceli Diaz went to meet up with the teenager in the 2300-block of South Drake Avenue to complete the sale of a dog that had been negotiated online, FOX News reported.

Police said that when the two women met up, the 14 year old pulled out a gun and struck Diaz in the head with it, WFLD reported.

Then the teenager tried to steal Diaz’s property.

That’s when Diaz, who was carrying her legally-owned handgun, and shot the 14-year-old girl in the chest, WFLD reported.

The teenager was transported to Stroger Hospital by ambulance in critical condition, WGN reported.

It turned out that the weapon she’d attacked her victim with was a pellet gun.

The 14 year old was arrested at the hospital on Saturday morning and charged with attempted armed robbery, WFLD reported.

She is scheduled to appear in juvenile court on Dec. 9.

"We're not sure where they met initially or how they communicated, but all we do know is that the 14-year-old did show up with other intentions and she pulled out a BB gun," Chicago Police Officer Jose Jara told WFLD.

"A BB gun can appear like a real gun and to anyone out there it's gonna appear like a real gun, to the police, and to any individual, and if someone's carrying and they have their own CCL they may use their own gun to defend themselves," Officer Jara explained.

However, while Diaz had a Firearms Owners Identification card, she did not have a concealed-carry license for the handgun that she used to defend herself from the armed teen, WFLD reported.

Diaz was taken into custody at 6:45 p.m. the day of the shooting in the 1400-block of South 57th Street in Cicero, according to WGN.

She was charged with aggravated unlawful use of a weapon and was due for a hearing in bond court on Sunday.

Aggravated unlawful use of a weapon is a felony. If convicted, Diaz faces one to three years in prison.

While we can debate the validity of people being required to have a CCW, It seems to me that the tone and headline of the story seem to indicate this is a problematic arrest. The law is the law, it was broken, the victim did not have a permit. Let's hope for a light sentence, but it is what it is. Strange tone I thought to have in this forum.

Let me get this straight, This woman was charged with unlawful use of a gun??? This was completely lawful. She should be charged with not being in possession of a concealed weapons permit! The police mischarged her! This is a miscarriage of justice! Let this woman walk with at the most a fine, if not just an order to get a concealed weapons permit. If she cannot afford one, I am sure someone out there with help her get one. This woman did the community a service by getting this bratty teenage off the street who committed a crime! Don't put her in prison for defending herself from a felon!

From 1982 to 2010 guns were banned in Chicago.

Since she legally owned the gun, I don't see her getting more than a fine and perhaps probation. You can't fault the police for doing their job. The main thing is she is clean. The FOID background check assured that (hopefully). Maybe the judge will require she fulfill the additional requirements for CCW and then she will be good to go.

Too bad legal gun owners can't just carry concealed, I don't see why they can't, other than dumb laws made by anti-gun politicians.

Where is the ACLU? State and local governments requiring a carry permit or license is a Civil Rights Violation. To Keep and Bear Arms (own and carry concealed or not) is an individual right. This is clearly stated in the 2nd Amendment. Since a person's rights to keep and bear arms is covered in the 2nd Amendment then the state has no say as per the 10th Amendment. Where are the Constitutional Scholars? What clause in the Constitution says that government can infringe our rights?

Aggravated unlawful use of a weapon? The charge should have been, unlawful possession (concealed) of a weapon. The use was not unlawful, aggravated or otherwise. It was self defense.

To the people who don’t understand the BB/pellet gun issue, it appears to be a real handgun hence the reason the criminal carried that particular pellet gun to intimidate the victim.

A few years back, when I still lived in Sweden, a immigrant kid was jumped by a bunch of neo-nazis. He defended himself with a box cutter and one of the nazis died. He was cleared from the murder, it was considered self defence, but he got a suspended sentence for illegally carrying a knife. I think that makes sense, that the carrying offence and the action are treated as separate cases.

There's something wrong with the law when a person is charged with a crime for defending themselves. Most of these anti-gun laws are passed by our legislatures as a favor to the police. It takes away the rights of the citizens to make things easier for the police.

Just one of the many reasons I am moving out of Illinois. I have an Illinois CCW. Illinois is far from the worst state for gun laws (Commiefornia, New Jersey, New York, etc) but they are not great and inconsistent throughout the state while lawsuits work their way through the courts from numerous municipalities. FOID Card? A BS way to generate revenue and discourage potential gun owners. Additional sales taxes on ammo in Cook County, shortening the period and raising fees for FOID and CCW license. The list goes on. So long Illinois!
