Teen Sentenced To 30 Days In Jail For Murder

District Court Judge Cristina Jaramillo sentenced Santiago Armijo to 30 days behind bars on Thursday.

Albuquerque, NM – A New Mexico teen was sentenced to just 30 days in jail for fatally shooting a man at an Albuquerque park in 2018.

According to police, Santiago Armijo and his co-defendant, Jeremiah del la Pena, were both 15 years old when they met 25-year-old Larry Desantiago at Tower Pond Park on the evening of March 1, 2018, KOAT reported.

The teens said they agreed to purchase some marijuana paraphernalia from Desantiago, but claimed they ran away from him.

Armijo ultimately used a gun del la Pena was carrying to shoot Desantiago in the chest in another area of the park, KOAT reported.

After the fatal shooting, the suspects ran to a nearby neighborhood, where they attempted to hide the jackets they were wearing at the time of the murder.

They were spotted by an Albuquerque police officer, who took them both into custody.

The teens claimed Desantiago tried to drive away with them in his car before they ran, but prosecutors say the murder was actually the result of a botched robbery plot concocted by the teens, KRQE reported.

Armijo, now 17, pleaded guilty to second-degree murder, unlawful possession of a handgun, conspiracy to commit tampering with evidence, tampering with evidence, and conspiracy to commit armed robbery on Thursday, according to KOAT.

Prosecutors asked District Court Judge Cristina Jaramillo to impose the maximum penalty, which would have kept Armijo in custody until the age of 21.

But Jaramillo said she believes the convicted murderer could benefit from 30 days in treatment at the Youth Diagnostic and Development Center, so she sentenced him to just one month in jail, KOAT reported.

According to prosecutors, the judge did not provide any further explanation for the lenient sentence, KRQE reported.

They have asked the court to reconsider, and are exploring the possibility of filing an appeal.

De la Pena, who was not charged with murder, has pleaded guilty to other charges related to the incident, according to KOB.

He is scheduled to be sentenced in January of 2020.

Not getting the whole story. I'm betting Desantiago was a predator of some type. Still 30 days is the joke of the year for murder. I am betting the judge knew some bad history on Desantiago and decided to reverse the judgement by the jury. That is far too much power for one udge to have. Law enforcement has a hard enough time catching these thugs, only to have all their hard work and risk laughed at by there batshit crazy judges.

He'll be back for another 30 days or so. Sad that the judges don't take public safety to heart.

THAT JUDGE NEEDS TO BE REMOVED AND THEN SERVE OUT WHAT SHOULD HAVE BEEN HIS SENTENCE, DEATH OR LIFE WITHOUT PAROLE, IT'S BECOMING OBVIOUS, THE BIGGEST CRIMINALS ARE JUDGES LIKE THIS ONE

The sentence is totally disproportionate to the crime. The community deserves to have this thug locked up for the maximum amount of time.

30 Days? He must have told the judge he had a date next week. Hope it was with her daughter. Soon enough, Armijo will run into a no-BS victim that takes his head off. That would be worth reading. Hope the judge is a witness.

While I’m sure we’re not getting the whole story here, 30 days for murder is an outright joke.

What a miscarriage of justice. With all the anti gun activists across the country, SHE should've given him five years on the gun charge alone. Again another liberal FEMALE judge contributing to continued violence and repeat offenders in society. Thirty years for murder, just unbelievable, should be removed from the bench...😠

District Court Judge Cristina Jaramillo sounds like an activist, bleeding -heart liberal judge-- just what we don't need more of . Part of the problem with young people today that commit violence is that they have no respect for human life. Sentences like hers' just reinforces that dangerous attitude. Thanks for nothing , Judge !

There is NO reason why this teen and teens like him cannot be sentenced to juvenile detention until he is 18 then sentenced to at least 20 years or MORE in prison. The liberal judges and people like her NEVER takes into the victims family or others effected by these criminals!! Working in a prison for over 30 years. I seen how little judges and listeners worry about victims and their families, friends, etc. MOST criminals are criminals because that is what they chose to be. There was an example where an offender hit his significant other with the claw side of a hammer to the skull of her. Fractured with multiple stitches and the poor guy got 10 years for aggravated battery instead of attempted murder. Did 5 years, got out, had another woman, used a butcher knife and stabbed her down her back. Multiple stitches, 70 or so, got the same type of sentence and got out again in 5 years. He also stalked those women by phone during and afterward. But that is another issue. Judges and liberals need to CARE ABOUT THE INNOCENT!!! Thank you for listening!!
