Kennewick, WA – A former middle school teacher’s aide was sentenced to just 30 days behind bars for facilitating her husband’s sexual predation of a 13-year-old student.
Prosecutors said that 29-year-old Kimberlee Farber helped her husband, 32-year-old Roy “David” Farber, communicate with the 13-year-old girl at Chinook Middle School, the Tri-City Herald reported.
Court documents said the victim’s parents learned about David Farber’s predatory behavior on Jan. 2, 2018 when he gave them a letter professing his love for their underage daughter, according to Heavy.
He had told the 13 year old that they couldn’t get into trouble for what they were doing because of his job as a correctional officer.
Court records showed that Kimberlee, who was a paraeducator at Chinook Middle School, provided her husband’s victim with a cell phone so that he could communicate with the girl after her parents took away her cell phone.
She also delivered a letter from her husband to the girl at school, KAPP reported.
Kimberlee told police that her husband had expressed an interest in younger girls and she was just trying to save her marriage.
David Farber, a former correctional officer at Two Rivers Correctional Institution in Umatilla, Oregon, pleaded guilty in Benton County Superior Court in December of 2018 to sexual exploitation of a minor, second-degree child molestation, communicating with a minor for immoral purposes, and two counts of second-degree possession of depictions of a minor engaged in sexually explicit conduct, the Tri-City Herald reported.
He was sentenced to 10 years in prison in April after he expressed his desire to continue his relationship with his victim to Community Corrections Officer Katti Foltz, the Tri-City Herald reported.
“It should be noted, which is an extreme concern to the Department of Corrections, [Dave] Farber informed the undersigned he wants to rebuild a relationship with the victim,” Community Corrections Officer Foltz wrote in her report. “Farber admits he is in love with [the victim], and wants to be man and wife.”
Defense attorneys argued that a six-year sentence would be sufficient for David Farber, but the community corrections officer told the court that the former corrections officer should get the maximum of 10 years.
“The [Department of Corrections)] considers Farber an extremely high risk to re-offend based on: the circumstances of the current crimes; his admittance he still wants to be man and wife with the victim; and his own concerns with being around minors,” Community Corrections Officer Foltz wrote in her report.
She said David Farber had shown no remorse and has gotten recent updates and pictures of his victim, the Tri-city Herald reported.
His wife, Kimberlee, got off much more easily despite her willing participation in the crimes.
Police said Kimberlee took the job at Chinook Middle School for the express purpose of contacting the 13 year old for her husband, Heavy reported.
But the prosecutor, Anita Petra, said that the victim’s family considered Kimberlee to be family and did not want her to be sent to jail, KAPP reported.
Petra said that an evaluation had determined that Kimberlee had mental health issues that may have been aggravated by her abusive husband and contributed to her criminal behavior.
She said the family did not want to put the victim through a trial and simply wanted closure for the case, KAPP reported.
Petra said the family had asked the court to order treatment and prevent Kimberlee from working with children again and both requests were granted.
Although Kimberlee was originally charged with felony communication with a minor for immoral purposes, the judge allowed her to plead guilty to a gross misdemeanor version of the same crime, according to KAPP.
The judge sentenced Kimberlee to 30 days in jail on Thursday and ordered her to register as a sex offender for 10 years.
