Surgeon Arrested For Hitting Cop With Car Is Awarded $1.2M In Lawsuit

The doctor has been awarded $1.2 million after fleeing from police.

Manhattan, NY – The former Bronx cancer surgeon who allegedly told police she was the real “hero” before hitting a New York City police officer with her car in 2016 has been awarded $1.2 million dollars in a lawsuit against the officers.

Rachel Wellner had sued for $30 million in her excessive force lawsuit, but the jury unanimously decided she only deserved a $1.2 million payday, according to the New York Post.

“I’m the hero – the cops are not,” Wellner allegedly told the officers before she allegedly ran into New York Police Officer Niguel Vega’s legs with her Volvo in the 2016 incident, the New York Post reported.

The incident occurred at approximately 9:45 a.m. on Feb. 18, 2016, near the intersection of Eighth Avenue and 55th Street, according to the New York Post.

Wellner, who was on her way home from work, pulled her vehicle to the curb so she could run in to the Vitamin Shoppe.

She left her vehicle blocking a crosswalk, and was met by two New York Police Department (NYPD) officers when she returned to her car.

That’s when she learned that she was receiving a parking citation.

“I’m a doctor,” she said dismissively, according to police. “I have patients that are dying. I have to go.”

She became even more irate as the confrontation continued.

“I’m the hero – the cops are not,” Wellner declared, according to the officers. “I don’t accept the summons.”

“All women who are cops are d--es,” she added at one point, police said.

By the time officers went to take the Ivy League-educated surgeon into custody, she was already sitting in the driver’s seat of her vehicle.

“Help! Police are assaulting me!” she began wailing.

She then hit the accelerator, and struck Officer Vega in his legs.

Wellner was originally arrested on charges of resisting arrest and reckless endangerment, but later pleaded guilty to a reduced charge of disorderly conduct.

She was sentenced to two years of conditional discharge, and was given 10 days of community service.

Wellner was also fired from her prestigious position as the senior breast surgeon at Montefiore Einstein Center for Cancer Care.

She denied having made the “hero” comment, and claimed that she only tried to flee the scene because she was in fear for her life.

According to Wellner, the incident escalated after she asked the officer who was writing her a ticket to hurry up, so she could get back to her patients – even though she was actually on her way home.

She said the officer asked her if she was “some sort of hero or something.”

“No, I don’t consider my self a hero,” she claimed to have responded. “You guys are heroes. But I do have patient emergencies.”

Wellner alleged that one of the officers then “cocked his arm back and punched me with all his might in my chest.”

“He grabbed me right along my rib cage, by the breasts, and started squeezing my body as hard as he could,” she claimed, according to the New York Post.

Wellner said she panicked and hit the accelerator, and denied having ever struck Officer Vegas with her car.

Police apprehended her at gunpoint approximately two blocks away.

“My whole life has been robbed — my job, my passion, my patients, my future, my reputation,” Wellner bawled during an interview with the New York Post. “All over a parking ticket. A parking ticket that escalated into physical violence, through no fault of my own.”

She claimed that the officers were the ones responsible for what occurred.

“Here I was, trying to defuse a situation, offering to move the car, apologizing,” Wellner complained. “I got the feeling I was being pre-judged. The optic was, ‘Here is a doctor who thinks she can do anything she wants.’”

Her attorney, Jon Norinsberg, alleged that the officers outright lied about what occurred during their contact with Wellner.

“The officers’ lies have permanently destroyed Dr. Wellner’s career and reputation,” he said.

“I definitely didn’t hit a police officer,” Wellner added.

Wellner claimed that the incident left her with post-traumatic stress disorder, and that she contemplated suicide due to feeling humiliated.

She said she could barely leave her $4,500-per-month apartment, and that she was too afraid to drive.

Wellner applied for a dozen different positions in five states, but everyone refused to hire her after they “Googled” her, she said.

A Manhattan federal court jury began hearing her case this week, the New York Post reported.

New York City Law Department Attorney Hannah Faddis told the court that Wellner parked across both the crosswalk and a bike lane while she ran in to the store that day, and said that the doctor lied when she told police she was in a rush to get back to work.

“She was going home,” Faddis told the jury. “She just didn’t want to be inconvenienced.”

After she was taken into custody, police allowed Wellner to use her cell phone so she could call her employer, Faddis added.

Instead, Wellner called a reporter at the New York Post.

Since being fired from her job, Wellner co-wrote a movie script about her days of partying as a Dartmouth College undergrad, The New York Post reported.

She’s also penned a semi-autobiographical erotic novel, began a series of children’s books about a kangaroo, and started performing as a stand-up comedian.

I would need to see the bodycam footage to know how to feel about this. Assuming that unlawful arrest claims were precluded by Heck doctrine and that the excessive force claims were not precluded by Heck doctrine, it is interesting to consider how to apportion the damages between the precluded claim and the not precluded claim. Maybe the jury thought that $28M of the damage was due to unlawful arrest and $1.2M was due to excessive force.

As Dr. Wellner’s attorney, I feel the need to set the record straight. This “news” article is false, misleading and dishonest. This lawsuit was about the LIES that the police officers told to the prosecutor following this incident. Specifically, the officer claimed, falsely, that he had been struck by her car. The video of the incident, as well as still photos from the video, showed that NO contact took place between her vehicle and the officer. Further, while the officer claimed that he sustained visible injuries to his legs — telling the prosecutor that he had “bruises, swelling and substantial pain” — in fact, there were NO injuries whatsoever to either leg. This was confirmed by two medical experts who testified at trial, an orthopedic surgeon and a radiologist. Despite these “phantom” injuries, the officer took off two weeks of work (fully paid) and then went on limited duty for another week (also fully paid). Did any news story report these facts???

As a result of the officer’s fake injury claim, Dr. Wellner was charged with serious crimes, including leaving the scene of an accident involving personal injury and reckless endangerment. When her boss at Montefiore read the news article — which reported the false “hit by a car” and phony injury claim — he decided immediately to fire Dr. Wellner. So she permanently lost her job as a cancer surgeon as result of completely false, dishonest claims by the police.

That is what the jury found, and that is what the case is actually about. Not that you would ever know it from reading this article or the many others that hace vilified and condemned Dr. Wellner based on a totally inaccurate, misleading and dishonest summary of the incident. Thankfully, the jury, after hearing the TRUTH, found agains the police and held them accountable for what they had done to Dr. Wellner. But the lies have permanently and irreparably destroyed Dr. Wellner’s career and reputation, and no amount of money from a jury will ever bring that back. I just wanted to set the record straight.

I don’t know what it is about parking tickets, but it’s been my experience that people go psycho when they are being issued one.

I worked traffic for 2 decades and wrote 1000s of speeding tickets, but most people, when issued a speeding ticket just say, “Thank you” or “Sorry” and go on their way.

However, parking citations just send normally sane people into the outer regions of irrational behavior. It’s a parking ticket that gets turned into a felony.

Anyone else read that it said “she was on her way home after work, then stopped at the vitamin shop”? But when she was confronted by the officers, she said she was a doctor and that patients are dying and she has to go? So if her patients are dying at that very moment that she tried to dismiss the violation and officers, why was she going home, though she had time to stop at the vitamin shop? There’s nothing life saving at a vitamin shop. Unless she needed female viagra because she’s a cold evil bitch!? Idk. And if she was such a top notch surgeon, with all this special treatment going on, don’t you think she would’ve kept her position? I mean, to me, “firing” a surgeon would do nothing but hurt the patients....... so there’s a possibility, that maybe just maybe, she was already a bitch and if the story is right, that’s how she really is, so maybe her colleagues found this a great time to remove her from her senior position? but overall, it all started from parking in the crosswalk, that just goes to show how “special” she thinks she is, which leads to the probability that she is capable of saying those types of comments.

In my experience, she may not have meant to hit the cop, but I believe she did it. Most doctors I’ve met have a sense of entitlement that only feminists and Leftists (but I repeat myself) can beat. She wanted to run in the store and didn’t care about the traffic laws she violated.

Her attorney said there is video evidence that she never hit the cop.... why hasn't this evidence been shared with the media? If the cops were wrong, and they did lie about the incident (and there is video evidence that supports that claim), than that is a valid reason for her to win the lawsuit, and i hope that evidence is used to eliminate any potentially bad cops. But unless there is clear evidence that they were wrong, and she was right, I'm still going to be siding with the cops.

However, this whole situation is still 100% due to her acting like an entitled brat, who felt the rules shouldn't apply to her. She's 100% responsible for her actions, and the resulting career damage because of what she did. There are several ways this could have ended that didn't hurt her career, yet she choice not to do any of them. No sympathy at all for her.

This story has so many loop holes in it it makes absolutely NO sense!!!! She was illegal parked, she made a phone call to the media after being placed in the law enforcement vehicle for attempted murder of a law enforcement officer in my opinion she ran over the law enforcement officer!!!!! this is really messed up, I don't care if she is a doctor, she had time to stop at a vitamin shop she has time to receive her parking ticket. The judge who allowed this should be disbarred. The judge is more of a problem than the doctor.
