Police Lieutenant Indicted For Murder For Shooting Active Shooter

Micheal Ann Godsey fired at her mother, police, and at least one citizen during a shooting spree in May.

Oklahoma City, OK – A Blackwell police lieutenant who stopped an active shooter during a rolling gunfight has been indicted for second-degree murder.

“It’s a sad day for law enforcement and society,” the lieutenant’s attorney, Gary James, told The Oklahoman.

The incident began at approximately 3 a.m. on May 20, when Blackwell police received reports that someone was firing a gun in the 1300-block of South Main, KFOR reported.

At least one of the rounds had struck a vehicle.

While officers responded to the scene, the dispatch center received additional calls that someone in a white pickup was firing rounds at several locations around Blackwell.

The suspect, later identified as 34-year-old Micheal Ann Godsey, ultimately opened fire on police as they pursued her through the town, The Oklahoman reported.

"She shot at the police twice. She has shot at her mother twice. She has shot at a private citizen. We know she fired other rounds around town,” James told the paper.

Blackwell Police Lieutenant John Mitchell managed to pull in behind the active shooter’s vehicle.

"He took his AR-15 and he started shooting through the front windshield at her,” James said, according to The Oklahoman.

Godsey jerked the wheel and abruptly turned at stopped near Doolin Avenue and 13th Avenue, KFOR reported.

Lt. Mitchell and another officer fired additional rounds at the suspect’s pickup.

They discovered the shooter dead in the driver’s seat a short while later.

One of the officers suffered a minor injury during the shootout, according to the Associated Press.

James said that Lt. Mitchell did what he had to do to stop a “violent, fleeing felon,” The Oklahoman reported.

He noted that the lieutenant had completed active shooter response training shortly before the fatal altercation, and that an independent internal affairs committee had cleared him of any wrongdoing.

On Nov. 21, a state grand jury determined that Lt. Mitchell engaged in “imminently dangerous conduct” towards Godsey without excusable or justifiable cause by firing approximately 60 rounds during the gun battle, The Oklahoman reported.

He faces up to 10 years in prison if he is convicted of the second-degree murder charge against him.

Lt. Mitchell was released on his own recognizance during a bond hearing on Monday, KFOR reported.

He was subsequently processed at the Kay County Detention Center before he was allowed to return home.

Oklahoma Fraternal Order of Police (FOP) President Jason Smith said he fully supports Lt. Mitchell.

“We look forward to this working through the justice system,” Smith told WFOR. “We believe that when the facts of the case are brought out to the public, that LT. Mitchell will be put back to work where he needs to be.”

Using deadly force was the last thing the lieutenant wanted to do, the union president added.

“He didn`t wake up that day with the [intent] to take a human life,” he told KFOR. “It`s the worst thing that he could ever imagine having to do.”

Smith noted that the indictment against Lt. Mitchell marked the “first time in American history that a police officer – or anybody – was charged with the crime of murder for shooting at an active shooter,” KTUL reported.

He said that he believes Lt. Mitchell will be acquitted of the charge against him once all the facts are known, according to KFOR.

Lt. Mitchell’s supporters said they were stunned to learn about the grand jury’s indictment, KTUL reported.

"To me, you return fire until the threat is neutralized,” Sean Ingram told the news outlet. “You don't know if it's going to be one or one hundred.”

“You’re being shot at,” another resident added. “Where do you draw that line?”

Ingram said that Lt. Mitchell is the most honorable person he knows.

“I will back him all the way,” he said.

Lt. Mitchell’s preliminary hearing has been set for Dec. 18.

At the end of the day, it's extremely unlikely that they'll get a second-degree murder conviction on a police officer who was acting in the interest of public safety, and who killed an offender that was actively trying to murder him.

If this doesn't qualify for justified use of deadly force then nothing does. You might as well just disarm the police and change their active shooter training to 'Wait until the gunman runs out of ammunition then arrest him once he's done killing'.

What special kind of idiot was on that grand jury?

Everyone involved in the indictment the judge the lawyers should all lose their legal licenses and be disbarred. The jurors who voted to indict this guy should all be put on a list where they can no longer participate in jury duty as they are obviously mentally deficient.

Sometimes it takes alot of rounds to neutralize a deadly threat. The human body maintains a remarkable ability to hang on to life until the absolute bitter end. https://www.youtube.com/watch?v=pdjcYjSsIok

Unfreaking believable I don’t understand why anyone would want to be a LEO these days. If anyone hears of a legal fund for this poor man I would like to know about it so I could contribute. In my opinion it wasn’t 1 round to many.

Dmos1357

So heres my recommendation for all LEOs as of today:

When the bad guy starts shooting. Yell at him, three times, in a pleasant, happy and non-threatening voice, "please stop shooting your scary gun at the nice people".

Then, when the suspect fails to comply, turn around and go back to the police station and have a cup of coffee.

I understand the use of deadly force , totally support this officer and the heroic actions he took to stop the threat. Wondering if the people who determined he was to be brought up on charges understand ? Already cleared by a investigation, wtf ?

One: What has happened to the state of Oklahoma that this is even an issue. Two: What the hell are these people smoking? Three: Shoot them until they are dead, or you run out of ammo. If you run out of ammo, do whatever else it takes to KILL these asshats!

I assume that there had to be a District Attorney/prosecutor that presented the case to the Grand Jury. It would be interesting to know if the DA was one of the many radical-Left anti--police DAs that were elected across the country by George Soros' money.

If this kind of foolery continues, eventually we will lose our police officers. When all hell breaks loose, we won't have anyone to call to defend us. This ruling is indicative of the leftist narrative of the Democrats where the innocent are taking responsibility for the criminals and the crimes they commit. Common Sense is about to take its last breath in our society. I hope none of those people on the jury ever need a police officer. I think I'd take my time responding. "I would have been here sooner but an Antifa mob was blocking the road." "I'm sorry I couldn't save your mother from the robber but our guns have been taken away." "After 4 officers were killed last week, there is only 3 of us to cover the city. It will be 3 hours before we can get to the scene of your accident." "There's an active shooter at the school? We will come but we won't engage in gun fire to stop him. One officer is already in prison for doing just that." Headline: "After 50 years, the police academy of Usacity is closing. The administration says that after the current class graduates, the school will close its doors. Enrollment for the freshman class was less than 10 students, as the risk of liability for police officers continues to increase. This current trend is being repeated all across the country. Many municipalities have less than one officer for every 8,000 people. Residents are waiting hours for police to respond to accidents because of the shortage of officers. There is no evidence that the situation will improve any time in the near future."

What were those morons on the grand jury smoking?? That criminal weas firing at her mother, civillians and the polcie and they STILL indict the cop?? The police shoud find out who was on that jury and let them do the job for an hour. They will not last a day!

Can we stop blaming democracts? Remember this all happened in OK, a notoriously republican town with what Im willing to put money on, a republican district attorney. If this all went down in NYC or Cali, that would be a different story. But when it happens in a red state, you still blame the blue. Republicans are wonderful at finding a way to blame everyone but themselves. Conspiracy theories, blacks, jews, snowflakes, ya'll have something or someone to point the finger at, meanwhile every single red state crumbles and uses more in federal aid than it gives. I 100% agree that this officer should not have been indicted or even brought to a GJ. Yes it will most likely be tossed, but still a terrible thing to drag anyone through and a poor message. Next time a DA wants nothing other than notches on their belts you'll consider voting them out.

Either the Grand Jury or the Prosecutor have an agenda against the Police. Time for a federal investigation of corruption.

One of these days, hopefully soon, police officers are going to walk off the job and leave the citizens to defend themselves. Of course, the shithole court systems will probably charge them with derelict of duty for walking off the job. I feel terrible for what is happening to the brave men and women that put their lives on the line every day, and show them nothing but respect when I see them, or get pulled over. When I do get pulled over, after they are done and are leaving , I always shake their hands and say "please be safe out there, and thank you for being there for us"

“ Lt. Mitchell and another officer fired additional rounds at the suspect’s pickup.”

According to their logic they should immediately arrest “the other officer” for attempted homicide. They are neglecting their duty.

Glad I'm retired. My son is a police officer and he's getting out. My good friend is also getting out of law enforcement. It's just not worth it anymore. Until things change it's not a job I would recommend to anyone. To all LEOs...get out while you can, let the scum have free reign, carry a gun to protect you and your family..to hell with everyone else.

So who’s supposed to die during a criminal started gun battle? The police officer or the bad guy? What other course of action did Lt. Mitchell have. So disheartening to read about this.

So with that logic, officers shouldn't go after an active school shooter. Seems they want officers like the ones in Broward County.

The state attorney leads the grand jury to either indict or not. It's obvious the state wanted to go after this officer for some reason. Sad day for law enforcement.

From the things taking place in our country, I am guessing that the higher ups(you can say politicians, judges, lawyers, and the Bleeding Heart Society) want a civil war. Things are getting out of hand. We depend on LEO's to protect us. Then this happens. Everyone that aided in making this decision, should be in jail. For treason, if nothing else. Total.B.S. This officer could have easily been wounded or killed. WAKE UP AMERICA.

Something wrong here. The man in charge is...

He is a Republican and has a very strong resume. I searched and searched. There's no way he would allow this, unless there was some merit, or he simply was unaware of the indictment. I would be curious to know his opinion. Because this indictment smacks of liberal politics. Plus the officer was cleared by internal affairs. If the officer had struck a bystander, then, maybe, press charges, but this was an active shooter who he (and a bunch of other LEOs ) killed.

This is almost exactly what happened to this officer in my hometown. Thankfully he was finally reinstated after 18 month of not knowing. This forum may have helped as I posted his dilemma, before it was resolved, which had a petition. The petition was closed once 2500 signatures were obtained and I met a cop shortly after, who advised me he would begin duty the following week. He thanked me for signing the petition.
