Officer Accused Of Using Excessive Force Against Suspect Who Attacked Him

Cincinnati Officer Doug Utecht was left bruised and bloodied after he was attacked by Durrell Nichols in June of 2019.

Cincinnati, OH – A Cincinnati police officer who was brutally assaulted by a violent suspect must now undergo questioning by the city’s Citizens Complaint Authority, even before his attacker’s case goes to court.

Someone filed a third-party excessive force complaint against Cincinnati Police Officer Doug Utecht, claiming he was abusive towards the assailant, 25-year-old Durrell Nichols, during an altercation at the Gamble-Nippert YMCA in June of 2019, WXIX reported.

Officer Utecht and several other officers responded to the facility after employees called to report that a man was acting disorderly and refusing to leave.

"He was called to the scene there because this suspect was harassing young ladies on the basketball court," Cincinnati Fraternal Order of Police President Dan Hils told WLWT. "And the staff there wanted him [Nichols] removed.”

“The officer was using all the patience in the world just to have this subject just leave,” Hils explained. “And then out of nowhere, he just attacks the officer and starts absolutely brutalizing him. He was a very large man. And the officer almost lost consciousness. It was a life-and-death situation."

Officer Utecht suffered bruises to the side of his head, a severe cut to his forehead, and his eye was swelled shut due to the attack, WXIX reported.

Nichols was arrested on multiple felony counts, but was found incompetent to stand trial several months after the altercation.

Just two weeks ago, the court determined Nichols is now competent to stand trial, WLWT reported.

But according to Hils, the officers who responded to the scene are the ones who are really on trial.

The Citizens Complaint Authority investigation was opened after a bystander at the YMCA filed a complaint alleging that the officers used excessive force against Nichols, failed to read him his Miranda rights, and that they made no attempts to de-escalate the situation, WXIX reported.

"He’s being interrogated by this civilian complaint authority. It makes no sense whatsoever," Hils told WLWT. "Now he’s being questioned before the bad guy even faces his day in court…This particular case is a personal insult to us as police officers."

Hils said that the complaint board should hold off on investigating the officers until after Nichols’ trial is concluded, WXIX reported.

“The process is wrong,” the union president told WXIX. “To be having these officers face – from an outside agency – interviews and interrogations referencing criminal cases…in some cases they’re dealing with confidential informants, all these things that they would have to possibly talk about or could be questioned about in these interviews, could threaten these criminal cases.”

Officer Utecht is due to appear before the Citizens Complaint Authority on Thursday.

“Justice hasn’t been served all the way,” Hils explained. “[Nichols] hasn’t been tried. He hasn’t been sentenced, but yet we’re being put under suspicion.”

“[Officer Utecht] did noting wrong,” he continued. “The [Citizens Complaint Authority] should be able to see that. Our own internal affairs, our own administration was able to see that from the video.”

Iris Roley, a longtime advocate of the police complaint process, said that the board must investigate citizens’ complaints within 90 days, WLWT reported.

"This a matter of life and death, policy and procedure and making sure that the citizens understand that they have a right, role and responsibility in how their government works for them," Roley told the news outlet.

I have had family and friends in Law Enforcement. Some retired, some gone and some still serving. I have never been more concerned about them as I have become in the recent years. Are there bad cops? yes. There are bad people in every walk of life. Is that the norm? NO. I would like to see harsher sentences for people who abuse those who pledge to serve and protect us. In this case there were many people who saw what happened and yet one person makes a complaint and that is being investigated. It doesn't make sense.

It is certainly possible to use excessive force just prior to getting the snot beat out of you. Not sure if that is waht happened here, but it is possible. Glad there is an investigation by some non-LEOs (LEOs would have a conflict of interest if they investigated this).

We need oversight for the oversight committees. It seems like the pendulum has swung in a direction that puts the "rights" of the accused over the victim. The officer gets beat up and he is the one on trial?! Hopefully we'll get to a point where things go back to normal. Maybe that will happen when crime is completely out of control and citizens come to the realization that liberal policies and those implemented by Obama are foolhardy.

BTW who is the complainant. Is it a friend of the suspect or possibly the same ethnic makeup? Most people don't understand Miranda and when it is required by the courts. The video is all the civilian complaint authority needs to make a decision. Stop the insanity!

It is absolutely moronic for any department to have a citizen review board to have any ability to hold officers accountable for the actions they take. I absolutely think all law enforcement is responsible to abide by department rules and suffer consequences if they fail to maintain those rules. Citizens are not capable of understanding the ongoing pressures officers deal with daily. They cannot comprehend the level of decisions needed to be made in every call.
This political correctness idiocy is creating an environment where police are placed in an ever-increasing hostile environment. I would not trade the 25 years I completed in law enforcement for anything. I am, however, finding it difficult to recommend the vocation to most who show interest.

FIRST AND MOST IMPORTANTLY. This officer was acting under the authority of his position. His training teaches self defense tactics, using what force necessary to defend himself to effect an arrest.
Second other officers duties was to protect this victim and others in the area.
They also have the backing of laws stating using what force necessary to effect an arrest of this person.

Using equal force and are allowed to up that force if necessary.
As for the advising of his rights.
At the time of the attack on officer/officers. This person would not be able to understand his rights at the time of arrest.
His rights would be read at the time necessary before questioning or at his booking.

Third the FOP Should provide a lawyer for this officer to sue this person as well as the business who allowed this person to be in business, which has insurance for their
Business for liability.
Also to sue this so called civilian board. You were a victim. GOD BLESS POLICE OFFICERS EVERYWHERE.

YOUR PRIMARY JOB......RETURN HOME TO YOUR FAMILY. Shame a civilian review board is set up before court hearing.

I have offered up this personal opinion before and I would like to restate it. There is no one easy fix, especially with the hierarchy and the politicians involved. I am not trying to oversimplify the situation. Bring in the National Guard. Give them the authority and powers to work alongside, support and assist our brothers and sisters in Blue in New York City PD to help return some kind of semblance of safety and security to this city. I feel sure that law-abiding and Blue supporting citizens would welcome this with open arms. Just my opinion Brothers and Sisters just thoughts.
