New San Francisco District Attorney Fires Top Prosecutors On Day Two

San Francisco District Attorney Chesa Boudin fired several of his most experienced prosecutors two days into office.

San Francisco, CA – San Francisco’s new district attorney fired several senior prosecutors on Friday, just two days after he was sworn into office.

Chesa Boudin, who ran on a platform to fix the city’s “broken justice system” and put fewer people behind bars, was sworn into office as district attorney on Wednesday, according to KTVU.

"I had to make difficult staffing decisions today in order to put in place a management team that will help me accomplish the work I committed to do for San Francisco,” Boudin said in a written statement released after the terminations became public.

The new district attorney is a career public defender who is the son of two cop killers and had never prosecuted a criminal case in his life before he became the district attorney of crime-ridden San Francisco in the city’s latest election.

Boudin is the son of Kathy Boudin and David Gilbert, two members of The Weather Underground who were convicted of murdering two police officers and a Brinks security guard during an armed robbery in 1981, the San Francisco Chronicle reported.

His mother, Kathy Boudin, was released from prison in 2003 after serving 22 years for the murders, but his father, David Gilbert, remains behind bars serving life in prison, NBC News reported.

The newly-elected district attorney ran his campaign on criminal justice reform, claiming that he was also a “victim” of his parents’ armed robbery in 1981 that left three people dead, two of them police officers.

Boudin has claimed he was motivated to run for office because he has experienced the results of the “destructive effects of mass incarceration,” NBC News reported.

He campaigned on a promise of sweeping reforms and beat an establishment favorite, interim District Attorney Suzy Loftus.

Boudin said his victory is a call for refocusing the criminal justice system on rehabilitation instead of incarceration or punishment, the Los Angeles Times reported.

Shortly after he was elected, Boudin announced that he planned to do away with adding gang enhancements to charges against defendants.

“I want to focus on holding people accountable for what they’ve done — not who they are,” Boudin said. “People are seeing their families impacted by overzealous uses of these gang allegations.”

Gang enhancements add years to felony sentences if prosecutors can show the crime committed benefitted a street gang, according to the San Francisco Chronicle.

It was predicted that Boudin might do away with the district attorney’s gang investigation unit entirely, but instead, he simply fired its boss.

Gang Unit Managing Attorney Ana Gonzalez was one of the first to go, the San Francisco Chronicle reported.

Boudin also terminated Michael Swart, the head of the Homicide Unite, and both managing attorneys in the General Felonies Unit, Todd Barrett and Linda Allen.

Felony trial attorney Kara Lacey and Tom Ostly, a trial attorney in the Crime Strategies Unit, also found themselves on the chopping block, the San Francisco Chronicle reported.

Boudin reportedly called the attorneys into his office one after the other on Jan. 10 and fired them.

Those who had already left the office for the day received a termination phone call from the new district attorney.

Sources told the San Francisco Chronicle that the move was detrimental to the morale of the entire District Attorney’s Office.

All of the prosecutors are at-will employees and the city charter allows them to be fired without giving them a reason.

But despite the fact they were not entitled to civil service protections, some of the now-former prosecutors said they may file lawsuits, the San Francisco Chronicle reported.

Boudin campaigned on a promise to focus the District Attorney’s Office on violent crime, so many are questioning why he decided to terminate so many of his most experienced felony attorneys.

They asked for it , they got it . I don’t hold the fact that his parents are convicted cop killers against him, not his doing. But I think the time spent visiting them in prison gave him a warped view of crime and punishment.

And? it's common for an elected official to fire those under him or her who don't agree with his new policies, or who they don't think will follow their thinking. Trump does it with ambassadors. Sheriff's do it with deputies all the time. It's often a sign that the newly fired professional refused to compromise their ideals, and refused to be "yes-men" to a leader who was more willing to pander to politics than actually follow the law.

They are at will employees, and serve at the pleasure of the elected official. This is what San Francisco's citizens wanted, now they get to deal with the consequences.

The firings, justified or not are within his power as the DA. I'm sure that the sacked attorney's have some way of remedying their firing. What does Mr Boudin's family background have to do with anything related to his current position and career? The crimes of his parents are exactly that, their crimes and not his. We don't refer to white southern men as the great grandchildren of slaveowners, klansmen and murderers. They should refer to Mr Boudin with the same courtesy and respect. I'm sure Mr Boudin worked hard to attain his new position and we have yet to see if his new policies will adversely effect San Francisco so we can't reserve judgement.

Maybe those experienced prosecutors weren't liberal enough for him. I don't get his reasoning for wanting to lighten up the criminal justice system in San Francisco and how it relates to his parents. He wants to empty the prisons and put fewer people behind bars? His parents were lucky that they didn't get the death penalty for murder, and especially as "cop killers." If more hard-line murderers got the death penalty, then that could possibly put fewer people behind bars. All this does is let criminals - both petty and hard-line - know that if you play your cards right you won't have to sit in jail for your crimes. And this is not just happening in San Francisco. Maybe this is his method of breaking his daddy out of jail. The worst is yet to come in this nation...

I feel sorry for law enforcement there, but on a positive note with New York and California trying to out due each other in criminal rights above law bidding citizens right. Criminals will start gravitating to these states making normal states safer. Also maybe we can all take a page from New York paying to relocate homeless people to other states and instead just pay to relocate criminals to these two states. Sounds like a win win.

San Francisco was always my favorite city. Even when I was in the Marine Corps, where it seemed like a lot of my friends hated California in general, said that San Francisco was a good liberty town. I was proud to be a Police Officer there and my friends will agree that I was one of the best. Now I do my best to avoid it. I am not ashamed to say what's happening with people like this person getting elected makes me cry. I have lived to 85, survived cancer, and otherwise have a good life, family, etc.

Why are you all arguing about what he is doing? The voters elected this guy based on his being up front and telling them what he was going to do. So if it results in more crime, more shit on the sidewalks, and more of a downhill slide into an unlivable city then it already is, its those same voters who will have to bear the price. And those of us who don't live there and don't agree with his approach will not be effected one way or the other. But we will be further educated in the insanity and complete disintegration of the Democratic Party and the ridiculousness of the Liberal Policies they espouse.
