New Hampshire Considering Bill To Ban Officers From Using Deadly Force

A bill proposed by a Libertarian group wants to restrict an officer's ability to use deadly force when making an arrest.

Concord, NH – New Hampshire police officials are pushing back on a proposed bill that would restrict law enforcement’s ability to use deadly force.

The legislation, proposed by a Libertarian group called the New Hampshire Liberty-Republicans, would revoke the legal authority law enforcement officers currently have to use deadly force if necessary while making an arrest, WMUR reported.

Police chiefs from across the state are fighting the proposed legislation and have said that restricting the use of deadly force would put officers’ lives in danger.

"It will make it much more difficult, if not impossible, for us to effect our jobs in certain situations,” Franklin Police Chief David Goldstein told WMUR.

The legislation, known officially as House Bill 218, is currently being considered by the House Criminal Justice and Public Safety committee, and the next hearing will be on Jan. 16, according to the New Hampshire General Court website.

The committee is expected to vote on the bill later this month, WMUR reported.

Actor Dean Cain, a reserve police officer and well-known law enforcement advocate, told The Daily Caller that the proposed law was not a good one.

“Terrible idea,” Cain said. ““No law enforcement officer wants to use deadly force during an arrest. Regrettably, sometimes it is the only option. Enacting a law like this is dangerous, irresponsible, and will lead to even more violence against law enforcement.”

He argued that deadly force is only supposed to be used as a last resort in all cases, and said it is usually only implemented to prevent injury to the officer or members of the general public.

One retired law enforcement source told The Daily Caller that things have changed in recent years so that police officers have to worry about more than getting injured or killed on the job.

He said that now they “have to worry if they’re going to lose their job or get sued.”

No officer would be willing to work under those conditions. I can't imagine any officer staying with a department in that state if the law is implemented. Officers would stop making traffic stops, checking suspicious people or putting themselves in any situation where there was a possibility they would have to use deadly force to save themselves.

Has anyone even read the bill? The bill has NOTHING to do with banning a officer from using deadly force. The bill only changes gender pronouns from "he" to "the officer" and includes the word "her". It literally took me 5 seconds to find this info

Interpretation is often difficult. But it appears Bill HB218 may prevent the shooting of a suspect when making an arrest even if the officer saw the suspect commit a serious crime with a gun which now makes him an immediate danger to the officer & others while making his escape. So while the officer chases the suspect he has to wait until the suspect threatens the officer or others again before being allowed to use deadly force. Sounds VERY DANGEROUS any way you interpret it!

Well, read the Bill and find nowhere where it implies or states that the officer cannot use reasonable force, including deadly force under conditions that are applied throughout the country. The Bill rewrites the previous Bill by making the new Bill gender neutral or inclusive of women.

Folks, it's New Hampshire. It's one of those New England states that takes Libertarian to the MAX and they are the polar opposite of Vermont. It's why New Hampshire is known as a Live Free or Die state, don't believe in big government and believe in a limited government. They believe in letting locals decide things and believe that citizens have the right to tell government what to do. Also, New Hampshire is a state where they would make a Liberal freak out and wet their damn pants. Trust me, New Hampshire is one of those states where you can own a 30 round AR-15 and legally build your own AR-15. OK, so I did read the measure, and read the existing statute. First, how do solve the hypocrisy of Officer's not being allow to use deadly force to affect an arrest, but a civilian can (RSA 627:5 Sec. III.b.)? Second, lets pretend we are in court. Attny: Officer, you hand cuffed the defendant after shooting him? Off: Yes. Attny: Was the defendant then "In-custody"? Off: Yes. Attny: Then he was under "arrest" at that point? Off: Yes. Attny: So you used "deadly force" to "arrest" my client? Off: Yes. But at the time I shot him, he was not "under arrest". Attny: Would you say that by shooting him, he was "seized", and therefore not "free to depart"? Off: Yes. Attny: So you illegally used "deadly force" to "arrest" my client. Off: Yes. Cue the prison blues for the Officer, and queue the tax payer pay day for the family! Yee haw!
