Mom Of Robber Killed By Citizen Hero: Why Did He Shoot Him Five Times?

The mother of the suspect is questioning why the man shot her son multiple times during the botched robbery.

San Antonio, TX - The mother of a man who was fatally shot by a good Samaritan during an armed robbery is questioning what happened to her son.

The botched robbery occurred Dec. 6 at about 9 p.m. at a Popeyes Chicken on South Flores Street that was full of customers, according to KSAT.

Police said Andrew Herrera, 19, was wearing a hoodie and a mask when he entered the South Side restaurant with a gun and confronted the good Samaritan, Carlos Molina, 32, and his family, according to Time.

Molina was eating at the fried chicken chain with his family when Herrera demanded that he hand over his property and threatened his children with a gun, police say.

According to KABB, Molina told Herrera that he had no money and asked whether his family could leave. Most of the family left the restaurant, but Herrera then pointed the gun at two of Molina’s children as they walked out of a restroom.

In response, Molina drew his licensed handgun and shot Herrera several times, police said.

Herrera died of acute lead poisoning.

Cynthia Ruiz, Herrera's mother, said she understands the man who shot her son was defending his family, but questioned whether shooting him five times was necessary.

She said she wants to see the surveillance video.

“Why shoot him four more times? Why did he shoot him five times?” she asked.

A police spokesman later said, “Here in Texas, if you’re in fear of loss of life, loss of property, you have a right to defend yourself.”

A spokeswoman for the SAPD said that no other information could be released due to the active investigation, according to KSAT.

She said that Trevon Atkinson, a second person involved in the Popeyes robbery, told her that Herrera's gun was unloaded.

Atkinson, who was the getaway driver, was arrested on Friday, Dec. 8, on aggravated robbery charges in the incident.

Both Herrera and Atkinson are believed to have been involved in numerous other robberies, according to the SAPD, who did not release further information.

A room card found with Herrera’s body at Popeye's linked back to a hotel room rented by Atkinson. Inside, police found jewelry price tags from an EZPAWN that they believe Herrera robbed the day before attempting to rob the Popeye’s, according to KSAT.

Praise the gentleman defending his family. Everyone who does this type of things should have the same ending. The mother probably did not mind the gifts he stole to give her that finally cost him his life. He probably passed a job hiring sign to go rob Popeyes

I would be so embarrassed and angry if my child committed armed robbery and brandished a weapon at children. I wouldn’t have the audacity to publicly speak out against someone who protected their own children from the danger my child put them in. Sure, I’d be devastated to lose my son, but if he committed a crime like this, I’d keep my mouth shut and mourn in private.

I can't believe she has the nerve to question this. This wasn't the first armed robbery he'd committed, he knew at some point, he could end up dead. Yes I feel sad for her, but her son brought it on himself. Doesn't matter if the gun was unloaded, no one else knew that

Atkinson should be charged in the death of his partner in crime. You shoot until the threat is neutralized. It sometimes takes more than one shot to hit a critical organ or nerve to completely disable.

I see she must already have an attorney if she has a life size photo of her criminal son. Who wouldn't have done the same in that situation? Just shooting once to protect your family is just nit enough.

My guess is that she's not very familiar with guns and doesn't understand that sometimes 1 shot is not enough to stop the threat or there's a possibility that the round misses the target.. In a situation like that, fear and adrenaline are pumping at an insane rate and that man fired the amount of shots HE felt required to shoot to stop the threat. It's THAT individuals perspective that needs to be taken into account not someone else's. Especially if that person wasn't there in the moment. I feel bad for the mother because no parent should have to bury their child, but her child is the one that caused the situation in the first place and that father took advantage of the small window of opportunity to save his family.

Forgive the tangent, but do you remember seeing in the news not too long ago, that a certain group of people were demanding restitution because their ancestors were brought to the US as slaves? If the actions of one group of people committed OVER a century ago, somehow require restitution (in liberal's minds), then this woman should be accountable for her child's actions, right? So, she should be required to pay restitution to all of the victims her son robbed, right? Bare minimum, why isn't this epic failure of a mother begging forgiveness from the people her kid robbed or tried to rob? Seems to me that she's a perpetual victim in her own mind.

Only five? Did he miss at all? I'd have emptied the entire cylinder/magazine on the scum. If for no other reason than to make sure that if he survived the gunshots he'd die of lead poisoning before they could dig it all out.

@I-am-me The article has no revelation as to whether this mother or son arrived via chain migration, legal immigration, or whether he's an anchor baby, etc, etc, etc.
I'm always a bit suspicious of why some information is frequently left out when certain groups are engaged in criminal behavior but a life history is presented when a caucasian is involved.
