Man Repeatedly Arrested For Raping Children Continued To Get Released By Judge

Officials are pointing fingers after a man was released by a judge twice after rape charges and went on to rape again

Taos, NM – A 29-year-old man was released by a judge twice after being arrested on rape charges and each time after his release the man was accused of raping other victims.

The three victims were ages 13, 5 and 19-months.

Raymond Hernandez was arrested Jan. 14 for sexually assaulting his girlfriend’s 13-year-old daughter, according to KOB. Hernandez was then released on a $10,000 bond by Judge Ernest Ortega with the only requirement that Hernandez had to wear a GPS ankle monitor.

Two days after his first arrest, Hernandez was arrested and charged with raping a 19-month-old girl who lived in the same house as the first rape victim, according to WPLG.

The second time, Judge Ortega released Hernandez on a $20,000 bail. The day after his second arrest, Hernandez was arrested and charged with raping a five-year-old girl who lived next door to the first two victims. After his third arrest, Hernandez was kept in jail. However, the Associated Press reported that the charges for raping the five-year-old girl were dismissed.

In the alleged rape of the 13-year-old girl, police said Hernandez gave the daughter and her friend alcohol.

The Associated Press reported that New Mexico Administrative Office of the Courts Director Artie Pepin said prosecutors didn’t ask a magistrate judge to hold Hernandez in the first two cases.

The Taos News reported that Judge Ortega recommended Hernandez be held without bond the day the case was filed. However, Judge Ortega ruled to release Hernandez on a $10,000 unsecured appearance bond because the District Attorney’s office didn’t argue to hold Hernandez.

“I’m speechless, he needs to pay and I hope the judge puts him behind bars and keep him there,” neighbor Gloria Lucero said, according to KOB.

Taos County Sheriff Jerry Hogrefe said he suspects there are more victims of Hernandez.

The district attorney said that his office hopes to get an indictment before Hernandez sees a judge on Thursday, according to KOB.

Why was he back in the home of the first victim? If the incident happened after his arrest for the first victim then whoever owns that home and the mother(s) of the victims should also be arrested for child endangerment.

Ok, put the JUDGE in jail and let HIM serve a sentence for statutory rape. That’ll get rid of the judge.

Go back to public hangings. There's some deterrence for you. Let the young people see that actions have consequences again.

Why weren't the neighbors sitting outside the house with guns? Fathers and mothers with rifles and handguns could have set up a neighborhood watch. (I think NM is one of the pro-2nd Amendment states.) Just their presence may have prevented the rape of the neighbor girl. And the mother who let him do this to her children should be charged with negligence, or child endangerment, as LizDuv stated.

The judge, rapists and the mother who let him back in the house after raping the 13 year old so he could rape the 19 month old baby all should be in jail.

If prosecutors and judges don't start doing their jobs the public will have no choice but to take care of things themselves.

DA and Judge need to be replaced. Neither did their job and need to face consequences for their actions just like the criminal in this case.

What the hell is wrong with the people in NM? I’m kinda surprised that they didn’t let him out again! Is all this known as ‘Latino Privilege’?

It's ultimately up to the Judge to make decisions on there cases so the bail and no prison time is on the Judge. The DA's responsibility is to suggest actions to the Judge if he doesn't it's up to the Judge to reprimand the DA because in his opinion he neglected his job.

I'm sure someone already said this, but why is the judge not being charged as an accomplice? He needs to do the same amount of time that this filth does and then disbarred (obviously!) Community, activists??? Now would be a good time to pull it together

I think that he should have to go and stay with the judge at their residence. Then we will see the bond being what it should, be if at all!!

Putting him behind bars is to good for him. He really needs to pay. Any Judge with any sense knows not to release someone like this. Time for a new judge.
