ICE Starts Arresting Illegal Immigrants At Courthouses In Defiance Of State Law

ICE agents arrested two illegal immigrants at the Sonoma County courthouse in direction violation of a California law.

Santa Rosa, CA – California lawmakers are outraged that U.S. Immigration and Customs Enforcement (ICE) agents arrested two repeat offender Mexican nationals at the Sonoma County courthouse on Tuesday.

California Governor Gavin Newsome signed a law in 2019 that prohibited federal immigration authorities from making arrests at courthouses without a warrant from a judge, the Associated Press reported.

But ICE said it doesn’t matter what laws California put in place because they don’t nullify federal immigration laws.

California law “will not govern the conduct of federal officers acting pursuant to duly-enacted laws passed by Congress that provide the authority to make administrative arrests of removable aliens inside the United States,” ICE said in a statement.

The arrests came a week after President Donald Trump’s announcement that he was sending federal SWAT teams to so-called “sanctuary cities” to help grab up wanted criminals, the Associated Press reported.

However, the Sonoma County arrests did not appear to be part of that enforcement action.

Sonoma County Sheriff Mark Essick confirmed that sheriff’s department was notified by ICE at about 7:45 a.m. on Feb. 18 that agents would be in the area conducting enforcement but said his office did nothing to assist them, Healdsburg Patch reported.

ICE said that both men they arrested at the courthouse in Santa Rose had been arrested and deported multiple times between 2004 and 2010, according to the Associated Press.

"The two individuals were previously arrested by local law enforcement and later released back into the community," U.S. Department of Homeland Security Public Affairs Specialist Jonathan Moor told the Healdsburg Patch in a statement.

Moor identified Antonio Hernandez Lopez as one of the arrestees and said the man had been arrested most recently in December of 2019 by Santa Rosa police and charged with inflicting corporal injury to spouse, DUI, and preventing a witness from reporting.

"Those charges are pending," Moor told the Healdsburg Patch. "He has a 2005 DUI conviction and a 2009 local ordinance conviction. He has been apprehended by U. S. Immigration officers four times between 2004 – 2007 and voluntarily returned to Mexico. He is in ICE custody pending immigration proceedings."

He said ICE agents also arrested Pedro Romero Aguirre.

"[Aguirre] has five criminal convictions spanning more than a decade, including: misdemeanor trespassing, driving without a license, misdemeanor DUI/alcohol, illegal entry, and most recently, Feb. 28, 2019 conviction for misdemeanor battery," Moor said. "In 2010, he was apprehended six times by U. S. Immigration officers. He voluntarily returned to Mexico three of those times and was order to be removed three subsequent times. He is in ICE custody pending removal."

Sonoma County District Attorney Jill Ravitch, Public Defender Kathleen Pozzi, and County Counsel Bruce Goldstein were outraged by the arrests at the courthouse and issued a statement condemning them, the Healdsburg Patch reported.

"ICE detention actions have no place in the court building, where they have the effect of scaring away witnesses and victims, and undermines the District Attorney's Office ability to hold the guilty accountable and protect crime victims," Ravitch said.

Goldstein insisted the arrests were "lawless" and said they violated recently-passed state law, the Healdsburg Patch reported.

"Rather than protect our community, these immigration arrests undermine our system of justice," he complained.

Despite the outrage, ICE officials have given no indication that they plan to stop making arrests at California courthouses.

"Under the Supremacy Clause of the United States Constitution, California Assembly Bill 668 cannot and will not govern the conduct of federal officers acting pursuant to duly-enacted laws passed by Congress that provide the authority to make administrative arrests of removable aliens inside the United States," San Francisco's U.S. Immigration and Customs Enforcement Field Office Director David Jennings said. "Our officers will not have their hands tied by sanctuary rules when enforcing immigration laws to remove criminal aliens from our communities."

Trump has accomplished so much in three years. Just imagine what he can do if we have both houses of Congress with Republican majorities. The Republican party is largely behind Trump now, as they realize that he is legit and he is the best thing to happen to the party in a long time. His hands will really be untied during his final term, and with Congress behind him, we will be able to accelerate the American Renaissance that has just begun.

Totally agree! And we need to encourage all Trump supporters to get out and vote in the Presidential elections in November. And we must help those voters who are not yet in the Trump camp to understand why voting him in for four more years is important. We must take care of this at the polls and everyone needs to do their part!

It's interesting that you would say that. Sheep usually blindly follow along with what everyone else does, and they do not have very good critical thinking skills (kind of like shat seems evident about you, based upon your posts).

Trump is quite the unusual president/politician. He is extremely controversial and does what he thinks is right, rather than politically-correct. He speaks directly to the populace, without getting his official statements sanitized by groups of people before being released. He was such a danger to the standard shepherds, that both US political parties, most media outlets, and most other world leaders were against him. He also does his best to fulfill his campaign promises, more so than any other politician I can think of.

His followers tend to be like him, and very disgruntled with the status quo, i.e., the exact opposite of typical sheeple like you who preferred Hillary.

Hi, again.

I don't mean tend to be like him in terms of personality or behavior. I really don't like Trump's personality and a little of his behavior. He is far too arrogant for me, and if he would moderate his speech a little, he would probably appeal to more people.

I love his policies, though, and how they have positively impacted my family and me directly.

Ya know, the Left-Wing media (most media) will tell you that Trump is the biggest liar ever. Well, he made a lot of promises to me before I voted for him, and he has done his best to keep most of them, in just three years, despite all the collusion and impeachment nonsense. That, to me, is a sign of integrity, hard work, and honesty.

My support for Trump is probably two or three times greater than when I voted for him. I never thought he would be anywhere near as effective as he is. I suspect that there are many who think like me out there, and even lots of Democrats who have seen the light, because Trump has actually delivered incredible results.

Same here. I had no idea how much shit he would have deal with. I had no idea he would take no salary. Even FDR took a salary and he was rich! I would never have guessed he would impose sanctions against China Europe and change NAFTA. All while deflecting daggers from every direction. Who would guess he would defy California state law and reroute water to farmers. Probably the greatest thing he has done is his tweets. They were calling it unprofessional and unpresidential for the longest time. Now they call it TRANSPARENCY. He bows to nobody and is beholden to nobody, yet he worked and fought tirelessly for We The People. Watching the Democrats trying to come up with a Candidate with a ghost of a chance of beating Trump is really becoming a comedy show. Before the primaries everyone's platform was DOWN WITH TRUMP. Now that they have to fight each other the conservative pundits are have a field day.

Right on. When Obama was my President, I sucked it up, even though I really disliked his policies. Only thing good he ever did, from my perspective, is killing Osama. Some liked the Affordable Care Act, but I did not. Remember keeping your doctor, health care insurance, and you would save $2500 per year?

Another thing I clearly noticed, during the primary debate that Trump attended. He was the ONLY candidate that DID NOT call Russia THE ENEMY. Since the Berlin Wall came down we have had good relations with Russia. As the one and only superpower capable of destroying us, why would we want to be their enemy? There are several reason, but none of them are good.

Also I was curious and there is this wonderful compilation of accomplishments, since he has been in office. Any liberal with the sense to read it would be crazy to vote against him.

First of all I do not mind if immigrants are in the US LEGALLY, but what pi$&es me off is these liberal minded quacks that defy federal law. They need to start putting some as$&s in jail for aiding and harboring these people that are here illegally. They need to start with blooming idiot Governor and work there way down. Furthermore officials should be made to refund all of the taxpayers money that has been given to these illegal immigrants for housing and healthcare.

I am a firm believer if you come to the US to live a new life you speak English or you can’t come in to stay. In my son’s class they have to stop class in order translate to kids that don’t speak English or the kids that speak some English have to translate to the parents that can’t speak it. My personal opinion is if you have already deported the guy four times then make this time permanent. Arrest anyone here illegally. I don't care if they have kids or anything else. If an American citizen does something illegal they are arrested and forced to face the circumstances despite how many kids they might have. It's as if some of these politicians haven't looked up the word illegal. They seem to think it means the person has done nothing wrong. As for those illegals who've repeatedly been sent back. Give them a couple of years at hard labor before sending them back and put them to work building the wall. And if they know they'll be spending years in prison if they keep coming back maybe they'll stop. Anyone here illegally shouldn't get food stamps, welfare or anything else. We have homeless veterans on our streets but are housing and feeding people who are in our country illegally. Let them have to stay in homeless shelters and eat at soup kitchens, get medical care at free clinics. It's good enough for people born here who've fallen on hard times. I'm all for having someone wanting a better life coming here legally and being a good productive citizen. But if you sneak in you're a criminal and deserve to be treated as one.
