How much more investigating does this prosecutor need, either charge the officer or clear the officer why are they playing games at this point. They cant force the officer to give a statement without giving him his Garrity rights for the department investigation and he is under no legal obligation to waive his 5th amendment rights even if he is subpoenaed to appear before a grand jury. in over 25 years of law enforcement, I have never seen a suspect in a criminal act appear before a county grand jury. Your witnesses yes, investigators yes, its the grand juries job to gave a true bill or a no bill on the charges you think you can prove. if you get a true bill then you have in an indictment on a criminal charge that you have basically had enough probable cause to go to trial with. This prosecutor is going to screw the pouch with this game playing.
So how does he get a pass on not talking? 6-7 months ago and not a word?
